In enrolling on your chosen course you are confirming that you have received enough information and are satisfied that the learning programme you have chosen is suitable for your needs and abilities.
Please note that our study programmes and materials are designed for adult learners. If you wish to enrol a student under 16 years of age, please contact one of our advisers to discuss this, and the extra support that may be required, before enrolling.
Our courses undergo regular redevelopment and updating. While we make every effort to ensure the information on our website is as up-to-date as possible, this may mean that the precise order in which material is presented in your course varies from the detailed outline given on our website or in our prospectus, although as a minimum the same material will still be covered. Course books may also vary occasionally according to availability and changes in syllabus requirements.
your quality guarantee
If you are not fully satisfied that the learning objectives you agree with your tutor have been met, we will refund your fees in full, as long as you have completed all your course assignments and sent them to your tutor for marking.
your course fees
Your course fee includes:
- your course materials and course book/s,
- individual tuition for three years from the date of enrolment.
Unless explicitly stated in the course description, your course fee does not include:
- additional reading material
- registration with awarding or professional bodies,
- exam fees to awarding bodies,
- fees payable to examination centres.
If you opt to sit an external examination, Learning Curve will provide you with such information as it has in its possession to assist you in making your examination arrangements.
payment by instalment
When paying by instalments there is an administration fee of £20. Course modules will be sent out in batches, as payments are received.
cancellations
Under the Consumer Protection (Distance Selling) Regulations 2000 you have a right to cancel your enrolment.If you decide to cancel your course we will provide a full refund if:
- you contact us by letter, fax or e-mail within seven working days of receiving your materials
- you return the materials (including course book/s) to us at your own expense
- we receive the materials (including course book/s) back in re-saleable condition.
You will be deemed to have accepted the course if you do not notify us otherwise within seven days after delivery. Risk of damage or loss of your course materials will pass to you upon delivery.
course transfers
It is also possible to transfer to a different course if:
- you contact us by letter, fax or e-mail within seven days of receiving your materials
- you return the materials (including course book/s) to us at your own expense
- we receive the materials (including course book/s) back in re-saleable condition.
You will be required to pay the difference in cost between your new course and your old one. Transfers are not possible after the seven day period has ended.
change of details
You must inform Learning Curve immediately of any changes to the contact details you supplied on your enrolment form. Failure to do so will mean that we are not able to provide you with course updates or further batches of study material in a timely manner.
extensions
We cannot support you after your three year study period unless there are exceptional circumstances. If you encounter difficulties that you believe may prevent you from completing your course within the three years, please contact a student adviser at the earliest opportunity to discuss the situation.
reasonable behaviour
We expect students and their representatives to refrain from using language that can be reasonably thought of as offensive or abusive, including swearing, shouting, sexist or racist remarks and libellous or defamatory statements. Should the behaviour of a student or their representative be found in our opinion to be unreasonable, we reserve the right to terminate the enrolment.
limitation of liability
Our liability for direct losses arising out of our negligence (other than in respect of liability for death or personal injury arising from our negligence), breach of contract or any other cause of action arising out of or in connection with your enrolment be limited to the fee you paid for your course.
Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for any indirect or consequential loss or damage whatsoever (including without limitation any loss of profits, loss of revenue, loss of opportunity or your liabilities to third parties) which you may suffer arising out of or in connection with your enrolment.
other terms
No relaxation or indulgence which we may extend to you, shall affect our rights under these Terms and Conditions.
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
data protection
You agree that, in relation to information, which we hold on you from time to time, we may:
- use your information to provide your course materials and tutorial support, and otherwise perform our obligations and enforce our rights under these Terms and Conditions;
- send information on other courses, if you request it.
- your information will not be used in any other way.
